To the Honorable Aeneas Shaw,

Sir,

I inclosed herewith a return of the 1st Regiment of Northumberland Militia, you will observe annexed to the return a list of the officers according to seniority, at the bottom of which I have inserted all the officer’s names recommended to fill the vacancies to the 24th Instant.

Agreeable to a Militia General order of the 14th of December last, I have to report for His Honour the President’s information a man by the name of Gardner Brown of the Northumberland Militia who refuses to take the Oath of Allegiance as directed in the afore said order, this man was reported to me last week by Captain Ward whose Company he belongs to, he has a family and large property in this township; in 1812, he refused to march to Kingston with the Flank Companies of this Regiment for which refusal he was committed to the Goal of the District for six months, since which time, he has neglected or refused to do any kind of militia duty; on the alarm in October last he left the Regiment on their route to Kingston and returned home for which he is now under sentence of a court martial for Twenty Pounds fine or twelve months imprisonment.
